Surrogacy in India - Commercial surrogacy banned in India and its impact on poor women

Actually, in Indian society, even after 73 years of independence, today there are many cases in which it is not talked about whether it is related to this surrogacy or it is related to women's periods or sex education. All these topics are considered very insignificant and no one wants to talk to them on the media or whether it is the common youth of the country and whenever such inflammatory issues arise on the country, whenever these things have been talked about then talk Those who are seen from the perspective of hatred are considered shameless. This is the reason that today no media, whether digital, electronic or printed, does not want to raise this issue, perhaps they also feel that this issue is quite trivial and talking about all these issues will bring disrepute to them.

Had to research a lot of facts in the internet and after watching a lot of video, I am going to share this article with all the witnesses in front of you.
 

Friends, before telling you all about the problem of surrogacy in India, it is my duty to tell you about surrogacy, what is it? What happens and why is it done? Let me introduce you to all these things. First of all, know what is surrogacy."Surrogacy is a assisted reproduction method where there is a transparent bilateral agreement between a woman and the couple in which the woman keeps the couple's child in their womb until birth, and this is possible when both husband and wife are failed to reproduce. " Now you know this process, in this whole process, first of all, a person who is willing to breed is willing.After that there is a bilateral agreement between the couple and the woman under which the couple has to take special care of the woman and she has to give the fixed amount of money every month to the woman then a medical test of surrogate in which the woman's reproduction capacity is checked.Then the reproductive cells (eggs) are taken from the female couple's body and the male reproductive factor (sperm) is also taken and both these types of cells are injected into the surrogate female and until that the child is born, embryo is kept in the womb of the surrogate, that is how the whole process is created.


There was a lot of discussion on this topic in India in the last months when an article was published in Nikki Asian Review, in which it was here that to completely ban surrogacy in India, many women living in poverty should get out of poverty will close the route. To talk about the history of Surrogacy, this practice was made legal in the year 2002. The motive behind giving legal recognition to this practice was also to promote medical tourism in India.After the recognition of this practice, India became the focal point of surrogacy because the price of surrogacy in India was the best work in the world. If we talk about the superpower country of the world, then the cost of surrogacy there is about one million dollars. Apart from this, there were no concrete laws for surrogacy in India. According to the CII report, surrogacy in India is worth nearly two billion dollars annually as of 2012. Over 3000 fertility clinics are functioning in India.

Although surrogacy brings a lot of profit in India, but due to irregular trade it also brings a lot of difficulty. Due to this, there was a demand in the country for a long time that a provision should be brought to perform surrogacy in a regular manner so that no one has to face any difficulties in it. The Law Commission of India advocated the introduction of legislation for surrogacy, but he also said that surrogacy should be banned commercially.They also gave many reasons for this. Following the Law Commission's suggestions, the Modi government, through a government notification in 2015, stated that surrogacy would be banned as a practice for foreign couples. 

Subsequently, in the year 2016, a bill was proposed in the Lok Sabha but after the dissolution of the house it expired. After which this bill was brought again in the year 2019 and it was also passed by Lok Sabha in the same year after which it was sent to the committee for amendment and still this bill is stuck in Rajya Sabha.

Let us see what is in this bill:


The constitution of surrogacy will be implemented throughout the country and in all its states. In this only surrogacy done for the purpose of charity will be valid.

Who has the right to perform surrogacy?

Indian couple who have been married for at least 5 years.

They have to give a certificate for the need of surrogacy and to prove their worth.

They will also have to take care that they will adopt the child born due to surrogacy and will not lleave eave them orphaned.

Who can become a surrogate mother?

The woman, a close relative of the couple.

The woman is already married and must have a child.

The age of a woman should be between 25 and 35 years.

The woman has never become a surrogate mother before.

There is also a provision for insurance for a surrogate woman, which should not only be limited to the woman's conception, but also benefit the woman for a long time after that.

Through this bill, emphasis has been laid on regular running of all clinics performing surrogacy, validation of all clinics will also be done.

In this bill, legal action will be taken to get the child's gender check done during surrogacy.
